Terms & Conditions — TorQ OBD Scanner

Please read these Terms carefully before using TorQ OBD Scanner. By downloading or using the app you agree to be bound by these Terms. If you do not agree, do not use the app.

1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your use of TorQ OBD Scanner ("the app"), developed and published by Rajkumar ("we", "us", "our"). By installing or using the app, you accept these Terms in full. If you are using the app on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Licence to Use the App

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use TorQ OBD Scanner on Android devices that you own or control, solely for lawful personal or internal business purposes and in accordance with these Terms.

You may not:

Copy, modify, distribute, sell, or sublicense any part of the app;
Reverse-engineer, decompile, or disassemble the app (except where permitted by applicable law);
Use the app in any way that violates applicable law or regulation;
Use the app to interfere with vehicle systems beyond reading and clearing OBD-II diagnostic data as intended.

3. Important Disclaimer — Not a Substitute for Professional Diagnosis

The information provided by TorQ OBD Scanner is for informational purposes only. It is not a substitute for professional mechanical diagnosis, advice, or repair. A fault code (DTC) read by the app indicates that a vehicle's on-board monitoring system detected a potential issue; it does not definitively identify the underlying cause.

Always consult a qualified automotive technician before making repair decisions based on information from this app, particularly for issues affecting safety-critical systems such as brakes, steering, airbags, or fuel delivery.

4. Clearing Diagnostic Trouble Codes

The "Clear codes" function (OBD-II mode 04) erases stored and pending DTCs and resets Inspection/Maintenance (I/M) readiness monitors. By using this function you acknowledge:

Clearing codes does not repair the underlying fault. If the fault condition is still present, codes will return.
Clearing codes resets I/M readiness monitors. Your vehicle may fail an emissions test until the monitors complete their drive cycles.
Permanent DTCs (mode 0A) cannot be cleared by mode 04 and can only be erased by the vehicle's own ECU once it verifies the fault is resolved.
We are not responsible for any consequence — including failed inspections, voided warranties, or ongoing mechanical issues — resulting from your use of the clear-codes function.

5. Compatibility and Accuracy

TorQ OBD Scanner works with ELM327-compatible Bluetooth OBD-II adapters on vehicles that support the SAE J1979 (OBD-II) standard (generally 1996 and newer passenger cars and light trucks sold in the US, and equivalent standards elsewhere). We make no guarantee of compatibility with every vehicle, adapter, or operating system version.

OBD-II data accuracy depends on the quality and firmware of your adapter, the protocol supported by your vehicle, and Bluetooth connection stability. The app displays the data it receives from the adapter; we cannot verify the accuracy of the adapter's readings.

Performance test timing (0–100 km/h, quarter-mile) is calculated by integrating speed data from the OBD-II adapter. Results are estimates and may differ from those obtained with calibrated, professional timing equipment.

6. Safe Use

Do not operate this app while driving. Always pull over safely and stop the vehicle before interacting with the app. We accept no liability for accidents, injuries, or damage resulting from use of the app while a vehicle is in motion.

The Heads-Up Display (HUD) mode is an assistive feature only. It is your responsibility to ensure the display does not obstruct your view or distract you from driving safely, and to comply with all laws regarding windshield obstructions and the use of electronic devices while driving.

7. Intellectual Property

All intellectual property rights in and to TorQ OBD Scanner — including the code, graphics, trade marks, and documentation — are owned by or licensed to Rajkumar. Nothing in these Terms transfers any ownership to you.

OBD-II is a standard defined by the Society of Automotive Engineers (SAE) and is not owned by us. ELM327 is a trade mark of ELM Electronics Inc. We are not affiliated with ELM Electronics Inc. or any adapter manufacturer.

8. Limitation of Liability

To the maximum extent permitted by law, and the developers shall not be liable for any:

Direct, indirect, incidental, special, consequential, or punitive damages;
Loss of data, loss of profits, or business interruption;
Vehicle damage or personal injury caused by acting on information provided by the app;
Damage resulting from app malfunction, Bluetooth connectivity issues, or inaccurate OBD-II data.

In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability, our liability is limited to the fullest extent permitted by law.

9. Warranty Disclaimer

The app is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Privacy

Your use of the app is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. Updates and Changes

We may update the app and these Terms at any time. Updated Terms will be posted at this URL with a revised "Last updated" date. Continued use of the app after an update constitutes acceptance of the revised Terms. If you do not agree with updated Terms, you should uninstall the app.

12. Termination

We may suspend or terminate your access to the app at any time, without notice, if we reasonably believe you are in breach of these Terms. You may terminate your use at any time by uninstalling the app.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of India.

14. Severability

If any provision of these Terms is found to be unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
